Miscellaneous Concerns

Miscellaneous concerns continually emerge with regard to Internet commerce. For instance, unauthorized sites may be found to infringe upon trademark rights. The James Dean Foundation in Indiana has sued a California fan for using James Dean's name. In CMG WorldWide Inc. v. America Legends, defendant Ronald Martinetti is being sued for the unauthorized commercial use of James Dean's name and likeness by selling memorabilia over the Internet. Given the number of unauthorized fan sites, and links to sites containing the names and likenesses of celebrities, this may be an important issue for many businesses.

Links to other sites may also be the cause of litigation. Linking a Web page to another page within another site may cause people to miss the logo and advertisements present on that other company's front page. Since links are an important element of any company's Web page, it is important to consider the ramifications of linking to certain sites.
