Chapter Eight. Preproduction > Dealing with Legal Issues

Dealing with Legal Issues

Don't even think about starting a major DV production project without a competent attorney on your team, especially one who specializes in entertainment law. Your friendly family lawyer isn't up to the job in this highly specialized area. If you're working in a business environment, seek the cooperation and support of your organization's corporate counsel. There's no substitute for professional legal advice. Here are some issues to run by the experts.

Incorporate and Insure the Production Entity

Producing a video as an individual is dangerous. You need to protect yourself and your colleagues as much as possible from liability. Accidents can happen on the set. Movies often lose money. Sponsors might feel their product has been misrepresented. Subjects or holders of real-life story rights might decide they've been portrayed incorrectly. Investors' moods shift every time there's a dip in the stock market. Hence, a common practice of media production companies is to incorporate a special entity just for the duration of a project.
