Federal Laws (CAN-SPAM)

The CAN-SPAM act, which went into effect on January 1, 2004, puts specific requirements on the senders of commercial email. The law includes requiring a valid physical postal address and honoring unsubscribe requests within a specific timeframe.

However, the CAN-SPAM act takes away the provision that many state laws had allowing ordinary users to sue spammers directly or through class-action lawsuits. The lack of this provision could significantly weaken the federal law.
